TERMS & CONDITIONS
SUBMITTING THE BELOW FORM MEANS YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING TERMS:
A. BOOKING
The Client acknowledges that all details submitted at the time of booking will be considered final. Any changes to the booking time or date must be submitted within 24 hours of the scheduled delivery time.
The Client agrees that the credit card they provide at the time of booking has sufficient funds to cover the bin rental, disposal, and tonnage fees that may occur. The Client provides their consent for the Service Provider to charge a deposit for the bin rental, at the time of booking, with future disposal and tonnage fees to be charged at a later date.
Due to traffic, unforeseen circumstances, etc., exact delivery times are not guaranteed.
B. DELIVERY
The Client must provide an attached image in their booking request to identify the Drop Off location, with the exact area clearly marked by pylons, etc. or added arrows/description to the image itself.
The Client acknowledges their full responsibility to ensure that the Drop Off site is clear of debris, level, and safe for our driver to access.
The Client acknowledges that delivery vehicles may drop fluids, and the Client will not hold the Service Provider for any spilled fluids at the time of delivery.
The Client acknowledges that delivery vehicles may leave behind tire marks on driveway/asphalt/concrete surfaces, and the Client will not hold the Service Provider for any tire marks at the time of delivery.
The Service Provider will use dunnage on driveway/asphalt/concrete surfaces, upon Client’s request, at the delivery site.
The Service Provider shall take pictures of the bin at the time of delivery, to ensure its present condition and compare at the time of pick up.
Once the bin has been dropped off, the Client assumes full responsibility of the bin until it has been picked up.
The Service Provider will not deliver on days with freezing, snow, or hazardous winter conditions.
Due to traffic, unforeseen circumstances, etc., the Client acknowledges that exact delivery times are not guaranteed. The Service Provider will deliver on the date as indicated by the Client, and will do their best to deliver as close to the selected window of time as possible.
C. LIABILITIES & INDEMNITIES
The Client agrees with the Service Provider to indemnify and save harmless the Service Provider in its capacity as a service provider from and against any and all liabilities, claims, damages, costs, losses, suits or actions of any nature whatsoever resulting from or arising out of booking, drop off, pick up, or any period of time in which the bin remains on the Client’s site.
The obligations of the parties under indemnities contained in this agreement shall survive the expiration or any termination of this agreement.
No bins may be moved by anyone other than a Trash Panda Bin Services driver. In the event that the bin is damaged while on the Client’s site, the Client acknowledges full liability and responsibility and consents to paying fair market price for the bin’s repair or replacement.
D. PICK UP
The Client acknowledges that the standard bin rental period is 5 business days. Should the Client wish to rent the bin for a longer period, they must either make note of the additional period at the time of booking, or notify the Service Provider within 72 hours after Drop Off (that is, 3 days). Additional $25/day charge for rentals longer than 5 business days.
If the Client wishes for a Pick Up earlier than 5 days, the Client may text, email, or submit online a Bin Pick Up request, which will be completed by the next business day before noon.
If, upon Pick Up, the driver confirms that there is new damage to the bin, extra charges may apply, as per Section 3.G.
The Client agrees that the Service Provider is not responsible for any fluids spilled on site.
Any bins with heaped loads above the Max Load Height will be charged an additional $100 fee per bin. The Client grants the Service Provider the right to remove any bin contents until the load is level.
E. DISPOSAL, TONNAGE & PENALTY FEES
The Client consents to the following:
All concrete, green waste, and dirt disposals MUST only rent a 12 Yard Bin.
We do not accept mixed landscape waste. All 12 yard landscape bins must be filled with ONLY one type of material i.e. soil, concrete, green waste.
Mixed landscape waste will be subject to a fee of $140 per tonne.
Green Waste Disclaimer: Logs and Branches do not count as green waste, they must be less than 1 inch thick and will be billed by weight at the landfill.
Soil Waste Disclaimer: Soil must not include roadbase/fill and any rocks must be smaller than baseball size or will be refused
Concrete Waste Disclaimer: Concrete waste with Rebar/Wire Mesh is subject to a fee of $200
10, 12, 15, 20, and 30 yard bins filled with materials OTHER THAN dirt, green waste, or concrete will be weighed by the Service Provider and charged a disposal fee of $175 per tonne. Minimum 1 tonne disposal fee will be charged per rental.
Any used drywall MUST be placed in a separate bin. Any bin with used drywall mixed in with other materials will be charged a penalty fee of $150, in addition to other disposal fees which could total as high as $500. Any drywall disposal will be charged a Drywall Disposal Fee of $230 per ton. The Service Provider will not accept any drywall that does not have either an approval slip or show a dated stamp AFTER 1990.
Any bin containing unacceptable materials will be charged a penalty fee of $150, in addition to other disposal fees which could total as high as $500.
ACCEPTABLE materials include:
Green waste
Includes grass, leaves, and branches (up to 45cm diameter and 2.6m long)
Tree Trunks/Large Branches must be in a separate bin
Dirt/Soil
Soil must not include road-base/fill/boulders/sand and any rocks must be smaller than baseball size or will be refused
Concrete
Concrete waste with Rebar/Wire Mesh is subject to a fee of $200
Cannot contain any natural stone/rocks i.e. granite, slate larger than a baseball
Household Garbage
Building/Renovation material
New Drywall must be in a separate bin
New Drywall Declaration and acknowledgement form required
Cannot be more than 8ft in length
Insulation must be double bagged
Fiberglass insulation only
Wood Waste - Finished
Cannot be more than 8ft in length
Includes solid wood, lumber, pallets and wood with glue (plywood, particle board, oriented strand board, laminated wood)
Wood can be painted, stained or treated (other than with creosote)
Wood Waste - Clean, unfinished wood waste
Cannot be more than 8ft in length
Includes solid wood, lumber, or pallets that do not contain glue and have not been painted, stained, or treated
Scrap metal
Must be a separate bin, cannot be mixed in with household garbage
Furniture
Food waste
UNACCEPTABLE materials include: (50% Surcharge depending on dump fees, for pick up of any items listed below)
Aerosol/Paint cans
Motor Oil containers

Additional Fees:
Delivering Material - $85
Urgent Bin Pick Up- $95 (Must provide 36 hour notice otherwise urgency fee applies)
Rebar/Wire Mesh - $200
Hazardous Heaping Bin - $100
Used Drywall NOT declared stamped past 1990 - Penalty fee of $150 and dumping fee of $230 per ton
Mattress Disposal - $30
Includes mattresses of all types (foam, futon, box springs)
Tire Disposal - $15 per tire
Must be in a separate bin if more than 10 Tires
Non-Soil/Green Waste Surcharge - $100
Hazardous Bin - $100
Pass by - $135.00 (The instance that Service Provider go to deliver a bin at the agreed on time and place and cannot deliver the bin for whatever circumstance)
Bin Rejection Fee - $250 (The instance that Service Provider cannot dispose of the bin contents at transfer station/landfill)
Door Open Fee - $95 (The instance that the Service Provider arrives and the bin’s doors are not closed/latched)
Cardboard
Additional Fees charged depending on landfill
Must be in a separate bin
Delay to pick up Fee - $55 per every 30 minutes
F. PAYMENT
The Client acknowledges and agrees to the following:
The only acceptable payment methods are: credit card, e-transfer or cheque
Total amount owing, including but not limited to disposal, tonnage, and penalty fees. Payment Due Date shall be due in 15 days upon receiving final invoice.
In the event of a returned cheque or insufficient funds charge due to automatic withdrawal, the Client will be charged an additional Insufficient Payment penalty of $75.00.
In the event that the Client is unable to pay their total amount owed within 15 business days, the Client will be charged an additional Late Payment penalty of $75.00 to their invoice.
If non-payment continues 30 days after Payment Due Date, the account will go into collections. All current and future rentals to the Client shall be suspended indefinitely. Any additional bins in the Client’s possession at the time of non-payment shall be picked up by the Service Provider without notice or appointment.
The Service Provider retains the right to access the Client’s site and return the same or comparable tonnage of materials as was removed at the time of Pick Up, without notice or appointment.
G. GOVERNING LAW
This agreement shall be construed and governed in accordance with the laws of the Province of British Columbia and the Client hereby submits to the jurisdiction of any court of competent jurisdiction of such Province in any action or proceeding whatsoever by the Landlord to enforce such rights hereunder.
H. TERMINATION
1. Either party may request by email or text message the re-scheduling (max 3 times)/cancellation of a bin rental \ within 24 hours prior to the scheduling booking date: should this event occur, there will be no charges. Otherwise, a fee of $135 will be charged.
2. The Service Provider retains the right to cancel the agreement for any reason at any time. In the event that the Service Provider cancels the agreement prior to Drop Off, there will be no charges. Otherwise, the booking fee is non-refundable.
I. AMENDMENT
This agreement may not be amended, redacted, or otherwise altered except through written amendment signed by both parties.
J. SEVERABILITY
Any article of this agreement deemed unenforceable, illegal, or unfair by a court of law shall be replaced by an acceptable article accomplishing the same basic goal of protecting both parties and their rights as they relate to this agreement.
K. SOCIAL MEDIA
The Client hereby agrees to & provides consent for the collection and use of the photograph/video(s) or electronic media images/videos as identified below in any presentation of any and all kind whatsoever. The Client understand that they may revoke this authorization at any time by notifying info@trashpandabins.com in writing via email. The revocation will not affect any actions taken before the receipt of this written notification. Media will be stored in a secure location and only authorized staff will have access to them. They will be kept as long as they are relevant and after that time destroyed or archived. Media collection may be done via Trash Panda Bin staff cellphone, camera, drone and/or videographer equipment.
